Same-Sex Family Law Agreements

Although Colorado does not recognize domestic partnerships, with our extensive experience in family and business law matters, there is much that Heckenbach Suazo LLP can accomplish for members of the LGBTQ community in Colorado by contract and other documents, which enable clients to have similar relationship rights, protections and responsibilities to those enjoyed by opposite-sex couples. Our attorneys are sensitive to issues faced by members of the LGBTQ community and can help clients bridge the gap between law and life in this evolving area.

The Power Of Contracts And Other Legal Documents

It is important to properly document these relationships and families. Otherwise, until same-sex couples are granted the same rights as opposite-sex couples, the law may grant important rights and privileges to biological family members, to the exclusion of their life partners.

A properly drafted contract, which is a binding and enforceable legal agreement, can accomplish this objective. Moreover, the lack of proper documentation and contracts will often lead to greater expense and conflict upon termination of the relationship than necessary.

Lesbian and gay couples can use several documents to protect their important relationships. These include:

  • Domestic partnership agreements — outlining desired rights and responsibilities inherent in the relationship and how you will handle your affairs, including how to divide assets and liabilities acquired during the relationship upon its termination/dissolution
  • Joint tenancy agreements and deeds with rights of survivorship — addressing how to handle real estate interests
  • Second-parent adoptions — giving a nonbiological parent parental rights
  • Name change petitions — allowing for parties to share the same last name and addressing transgender issues
  • Powers of attorney for minor children — granting rights to a nonbiological parent in the absence of a second-parent adoption
  • Domestic partnership dissolution
  • Durable health care powers of attorney — designating another to make health care decisions in the event of incapacity
  • Durable financial powers of attorney — designating another to make financial decisions in the event of incapacity
  • Wills — providing for distribution of property upon death
